Detained Children Have a Right to Education

IN JULY the TUSD Board voted to dedicate staff to research what right and responsibility they have to provide education to the 300 children being detained at the Southwest Key Facility. At that meeting, we packed the house and we are hoping to do that again.
Then on August 30th, Dr. Trujillo reported that the Southwest Key Program recommended that TUSD enroll the 300+ students at the Tucson Facility. The school Superintendent will again discuss the findings. Let’s pack the house again and let TUSD know that we want those children educated.
One of the biggest concerns surrounding the well-being of the children being housed at the Southwest Key facility here in Tucson is the question of education. Due to the lack of transparency and accountability, the level/type of education that these children receive is unknown.
Plyler vs Doe says that school districts service ALL children regardless of immigration status. Therefore, TUSD and all other districts provide services and education to children in group homes, foster homes, and shelters.The Southwest Key facility is located in TUSD, therefore, the children being housed there must also have the right to services provided by the school district. These services include but are not limited to: State approved education, district provided therapy/counseling, translators, and certified educators.
Last month TUSD Board member Kristel Foster proposed that TUSD investigate its responsibilities and rights as they relate to the children being kept at the Southwest Key facility. Depending on what legal routes they find, TUSD can then choose to fight legally to serve the children. If successful this would set a legal precedent nationally.
We are asking community members to fill the house this Tuesday the 14th during the TUSD Board meeting to support this effort:
-The questions being posed: What is the right of the district as it relates to the children at Southwest Key? What is the responsibility of the district as it relates to children at Southwest Key?
